The Trimble County Attorney’s Office prosecutes criminal cases in District Court, handling all Trimble County traffic, misdemeanor, juvenile and felony cases. Felony cases that begin in District Court originate with this office but are transferred to the Commonwealth Attorney’s Office in Oldham County if an indictment is returned by a grand jury. Criminal matters come to the county attorney’s office through investigations conducted by the Trimble County Sheriff or Kentucky State Police. The office prepares criminal complaints and arrest warrants and all processes search warrants when necessary.
The County Attorney also handles all juvenile dependency and neglect cases docketed in the Family Court. These cases involve allegations of neglected or abused juveniles. The County Attorney and her staff work closely with law enforcement and the office of the Cabinet for Health and Family Services in order to resolve these matters, which includes preparing petitions and presenting evidence in court.
The County Attorney’s Office also is the contract agent for child support establishment and enforcement. The office has approximately 500 active child support cases. Any person who needs assistance establishing paternity, establishing an order for child support, or collecting child support that is not being paid may contact the office for assistance. Complainants in these cases are not required to pay a fee for child support cases handled by the county attorney’s office.
Other responsibilities include prosecuting people who write cold checks. Any merchant who receives a check from a county resident that is later returned for insufficient funds may bring that check to the office. A letter demanding payment will be sent to the person on behalf of the merchant; a continued failed payment will result in a summons to appear in court.
The county attorney assists in the Court in the filing of guardianship cases whereas an individual over the age of eighteen is unable to handle their financial and/or personal affairs. This process allows loved ones to be appointed or the state, to assist in these areas if an individual is unable to handle their personal matters so potential exploitation doesn’t occur.
In regards to delinquent property taxes, the county attorney, contacts the property owner who has failed to pay their taxes on time and is involved in the legal process of collecting said taxes. The county attorney may elect to enter into a payment plan with the delinquent tax payer if the circumstances allows.
Finally, the county attorney is responsible for providing legal advice to the Trimble County Fiscal Court and all other elected county officials.
